These terms govern the use of Bequestly's website and the engagement of Bequestly's records coordination services. By using our website or commissioning an engagement, you agree to these terms. If you do not agree, please do not use our website or services.

1. Definitions
- Bequestly / We / Us / Our — the records coordination business operated from 29 Jalan Bukit Bintang, 55100 Kuala Lumpur, Malaysia.
- Service — the estate and heirloom records coordination engagements offered by Bequestly, as described on this website and in individual scope agreements.
- Client / You — the individual or family commissioning a Bequestly engagement.
- Engagement — a specific, scoped piece of work agreed in writing between Bequestly and the Client.
- Catalogue — the document or digital file produced by Bequestly as the primary deliverable of an engagement.
- Agreement — these terms, together with the written scope confirmation for each engagement.
2. Acceptance of terms
By commissioning an engagement or using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are commissioning an engagement on behalf of a family, you confirm that you have authority to do so.
Bequestly reserves the right to amend these terms at any time. Material changes will be communicated by email. Continued engagement of services after notice of a change constitutes acceptance of the revised terms.
3. Description of services
Bequestly provides estate and heirloom records coordination services, including document cataloguing, object photography and description, archive organisation, inventory notes and the writing of orientation documents. All services are purely administrative and informational in nature.
Bequestly does not provide legal, financial, valuation or any other regulated professional advice. Nothing produced by Bequestly constitutes legal advice, an appraisal, a valuation for regulated purposes, or a recommendation regarding any legal, financial or administrative matter. Clients are encouraged to consult qualified professionals for all such questions.
Services are available to clients in Malaysia. Engagements are conducted primarily in the Klang Valley area; arrangements for engagements outside this area are made on a case-by-case basis and confirmed in the written scope agreement.
4. Scope agreements
Each engagement is preceded by a written scope agreement specifying the services to be provided, the deliverables, the fee, and the expected timeline. No engagement work begins until the Client has confirmed the scope agreement in writing.
If the Client wishes to expand or alter the scope of an engagement, this must be agreed in a revised written scope agreement before any additional work is performed. Bequestly is not obliged to accept scope changes requested after an engagement has begun.
5. Fees and payment
Fees are as stated in the written scope agreement and are expressed in Ringgit Malaysia (RM). Current published fees are RM 470 for the First Conversation and Inventory Note, RM 2,240 for the Document and Object Catalogue, and RM 4,700 for the Chronicle Programme.
Fees are fixed per engagement. There are no hourly rates and no additional charges for correspondence within an engagement period, except where a scope change has been agreed in writing.
Payment terms will be set out in the scope agreement. Where an engagement is not completed due to Client cancellation after work has begun, Bequestly reserves the right to invoice for work completed to the point of cancellation at a pro-rata rate of the total engagement fee.
Where Bequestly is unable to complete an engagement due to circumstances within Bequestly's control, a full refund of any fees paid for uncompleted work will be issued within fourteen days.
6. Client responsibilities
The Client is responsible for ensuring that Bequestly has reasonable access to the household and materials required for the engagement, and that access is provided at the agreed times.
The Client confirms that they have the right to give Bequestly access to the materials included in the engagement, and that Bequestly's cataloguing and description of those materials does not infringe any third-party rights.
The Client is responsible for maintaining a secure copy of all deliverables after receipt. Bequestly does not retain copies of engagement deliverables after delivery and cannot provide replacement copies after an engagement has closed.
7. Intellectual property
The written content, methodology and descriptive conventions used in Bequestly's engagement deliverables are the intellectual property of Bequestly. The Client is granted a non-exclusive, perpetual licence to use, copy and share the deliverables for personal and family purposes.
The underlying materials catalogued — documents, photographs, objects and family records — remain the property of the Client or the relevant estate. Bequestly makes no claim on any such materials.
8. Disclaimers
Bequestly's services are provided in good faith and with professional care. However, the descriptions, references and notes produced in an engagement are based on observation, interview and reasonable inference. Bequestly does not warrant the completeness or accuracy of any catalogue entry, and no catalogue entry constitutes legal or financial evidence.
Bequestly is not responsible for the condition of materials before, during or after an engagement beyond the reasonable care taken during sessions. We handle all materials with care; however, we accept no liability for the condition of aged or fragile items.
9. Limitation of liability
To the fullest extent permitted by Malaysian law, Bequestly's liability to any Client in connection with any engagement is limited to the total fees paid for that engagement.
Bequestly is not liable for any indirect, consequential or economic loss arising from an engagement or the use of any deliverable.
10. Termination
Either party may terminate an engagement at any time by written notice. Where the Client terminates after work has begun, clause 5 (fees) applies. Where Bequestly terminates, any fees paid for uncompleted work will be refunded within fourteen days.
Termination of an engagement does not affect any rights or obligations that have already arisen.
11. Dispute resolution and governing law
These terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to attempt informal resolution first by written correspondence. If informal resolution is not achieved within thirty days, either party may refer the matter to the courts of Malaysia, which shall have exclusive jurisdiction.
12. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. Failure to enforce any right under these terms does not constitute a waiver of that right.
These terms constitute the entire agreement between the parties regarding their subject matter, and supersede all prior understandings, except as supplemented by the written scope agreement for each engagement.
